Terms and Conditions for the Sale of Painted Pictures by Tamar Perets
1. Overview
These terms and conditions (“Terms”) outline the agreement between Tamar Perets, the artist (“Artist,” “I,” or “Me”), and the purchaser (“Buyer” or “You”) for the sale of original painted pictures (“Artwork”).
2. Artwork Description
a. The Artwork sold under these Terms is an original, one-of-a-kind piece as described in the accompanying invoice or listing. Specific details regarding medium, dimensions, and title are provided prior to purchase.
b. The Artist reserves the right to use images of the sold Artwork for promotional, archival, and portfolio purposes.
3. Pricing and Payment
a. The final price for the Artwork is as stated on the invoice and is in Israeli New Shekels (₪) unless otherwise agreed in writing.
b. Payment shall be made in full via bank transfer to the account specified by the Artist. Payment details will be provided upon confirmation of purchase.
c. The Artwork will only be prepared for shipment upon receipt and clearance of the full payment.
4. Ownership and Copyright
a. The Artist, Tamar Perets, retains all copyrights and intellectual property rights to the Artwork. The sale of the physical Artwork does not transfer the copyright.
b. The Buyer acquires ownership of the physical Artwork and the right to display it privately. The Buyer may not reproduce, distribute, create derivative works, or commercially exploit the image of the Artwork without the prior written consent of the Artist.
5. Delivery and Shipping
a. The Artist will arrange shipping within a reasonable timeframe after payment confirmation. The Buyer will be notified with tracking information when available.
b. All shipping costs, insurance, customs duties, import taxes, and handling fees are the sole responsibility of the Buyer. These costs are separate from the Artwork price unless explicitly stated otherwise in writing.
c. Any provided delivery timelines are estimates only. The Artist is not liable for delays caused by carriers, customs, or unforeseen circumstances.
6. Returns and Refunds
a. All sales are final. Due to the unique nature of original artwork, returns and refunds are not accepted except in the case of damage incurred during transit.
b. If the Artwork arrives damaged, the Buyer must notify the Artist in writing (via email) within 48 hours of delivery and provide clear photographic evidence of the damage and packaging. The Artist will work with the carrier to resolve the issue, which may involve filing an insurance claim or arranging a replacement if possible.
7. Liability
a. The Artist’s total liability to the Buyer, for any claim arising from or related to this agreement, shall be limited to the purchase price of the Artwork.
b. The Artist shall not be liable for any indirect, consequential, incidental, or punitive damages.
8. Governing Law and Jurisdiction
a. These Terms shall be governed by and construed in accordance with the laws of the State of Israel.
b. Any disputes arising from these Terms or the sale of the Artwork shall be subject to the exclusive jurisdiction of the courts located in the Northern District of Israel.
9. Entire Agreement
a. These Terms, together with the final invoice, constitute the entire agreement between the Artist and the Buyer regarding the sale of the Artwork and supersede all prior discussions, representations, and agreements.
By completing the purchase of the Artwork, the Buyer acknowledges that they have read, understood, and agreed to be bound by these Terms and Conditions.
